A Texas-based company, Padre Island Combat Cruiser Rentals, has successfully defended its right to use HumveeRentals.com after AM General LLC—maker of the Humvee—filed a UDRP complaint claiming cybersquatting.
The panel applied the Oki Data rule, which allows resellers to use a trademark in a domain if they:
-
Actually offer the goods/services in question
-
Only sell those goods/services
-
Clearly disclose no affiliation with the trademark owner
-
Don’t try to monopolize related domains
The panel found the rental company met these conditions and operates a legitimate business renting Humvees for $150/hour.
While AM General could pursue the matter in court, the UDRP panel ruled against transferring the domain, marking the second loss for AM General against a rental company this year.
